Ex-proprietors of a group of Steak n Shake restaurants must stop operating the former franchises under a new name after agreements between the Indianapolis-based restaurant chain and the ex-franchisees went south.

Chief Judge Tanya Walton Pratt of the U.S. District Court for the Southern District of Indiana entered a temporary restraining order Wednesday in favor of Steak n Shake Enterprises Inc. and Steak n Shake LLC. The order prohibits iFood Inc., Shashi K. Rattan and Chandru C. Gurnani from operating restaurants known as Seans Shack at three former Steak n Shake franchises.

Steak n Shake entered an area development agreement with iFood in 2011 allowing iFood to open 10 franchise locations across North Carolina and Virginia. At the same time, Rattan and Gurnani entered into franchise and license agreements to operate a full-service Steak n Shake in Raleigh, North Carolina. The parties later executed additional agreements to open two franchises in Raleigh and Vienna, West Virginia, as well as one franchise in Garner, North Carolina

Second, the geographic scope of the noncompete provision is not unreasonably broad when, again, Plaintiffs may elect to reenter that market, and the barred territory is constrained to within five miles of the Authorized Location or any then-existing Steak n Shake or Steak n Shake Signature Restaurant, Walton Pratt continued.

How Much Do Steak N Shake Employees Make

So how much do employees get paid, on average? According to Indeed, pay can vary significantly, depending on the position. Glassdoor does note, though, that servers can expect to receive tips of $3 to $5 an hour as extra compensation, something that no other staff members receive. However, the restaurant recently announced some big changes, including news that the server position will soon be eliminated in favor of kiosks.

Based on Indeeds figures, it pays better to be in management, not surprisingly. Hourly wages for managerial roles include $12.64 for a retail assistant manager, $12.70 for a shift manager, $13.56 for a restaurant manager, and $14.82 for a store manager. On an annual basis, that comes out to $47,564 for a general manager, while district managers can make $73,451 per year.

Benefits also differ depending on the position. According to Steak n Shakes corporate website, hourly employees can expect employee meals, training, cell phone discounts, and flexible scheduling. Those in management roles, however, are entitled to medical and dental insurance, paid vacations, and a bonus program.

Steak n Shake permanently closed 51 company-owned units in the first quarter as sales and traffic continue to decline.

Six franchises closed their doors in the quarter, as well.

In an SEC filing, Biglari Holdings, which also owns Western Sizzlin and holds about 9 percent of Cracker Barrel, said the COVID-19 pandemic had an adverse effect on our restaurant operations, thereby resulting in the evaluation of company-operated restaurants for recoverability.

Biglari recorded a $10.3 million impairment charge in Q1 due to the closures and the expected impact of the COVID-19 pandemic on the future operating performance of other company-operated restaurants.

The closures come amid Steak ‘n Shakes ongoing strategy to turn over its company-owned units to single-unit franchise partners for an investment of $10,000. As part of the deal, the company charges the restaurant up to 15 percent of sales to lease the unit and equipment and the franchise partner gets 50 percent of the restaurant’s profits. The plan was first announced in August 2018.

At the end of 2019, 107 company-owned units were temporarily closed as Steak ‘n Shake looked for franchise partners. The 51 permanent closures in Q1 account for almost half of that total.
