Years ago, back in 2013, Steak n Shake expanded, for a short time, its hours of breakfast service from midnight to 11:00 am. However, that glorious moment of late night breakfasts was short lived and quickly forgotten.
That same year, the Steakburger chain also introduced the All Nighter menu. The All Nighter menu included new skillets, bacon cheese fries, and a seven patty Steakburger called the 7Ã7.
Designed to satisfy late night diners who wanted more variety of choices, the breakfast menu available past midnight and the All Nighter featured some of Steak n Shakes most craveable items.
As you probably guessed, All Night Breakfasts and the Up All Night Menu are no longer available. Weve been praying for their comeback ever since they were discontinued, but unfortunately our prayers have not been heard. Well, at least not yet.

As is my common practice when ruling on preliminary injunction motions, I will immediately refer this case to Alternative Dispute Resolution. The parties have spent a great deal of time and money on the preliminary injunction phase of the case. From the discovery undertaken thus far and the arguments made, both parties should have a very good understanding of their own case and of their opponents case. From a business point of view, resolving the case at this point would allow the parties to get back to selling burgers and to stop spending enormous sums on litigation expenses.
I expect the parties to make solid and good faith attempts to resolve this case before they embark on the expensive discovery and motion practice necessary to get this case ready for trial on the merits. During the preliminary injunction phase of this case, there were frequent disagreements over things that should have been resolved without much discord, and there were frequent accusations of sandbagging and tactical abuse of the rules. If this behavior continues during the mediation period by either party I would not consider that to be good faith compliance with the referral to ADR. I expect both counsel to specifically discuss this paragraph with their clients, as I expect the clients to understand that sharp practices increase the expense of litigation.

Franchise fraud again. Not surprisingly, another franchisee carcass was spotted lying outside the federal district court in New Jersey last week. The franchisee plaintiff, Cornerstone Investment Partners I, LLC , sued its franchisor, Steak n Shake Enterprises, Inc., the defendant. The franchisor moved to dismiss the franchisees case, and the Court granted the motion. In deciding the motion, the Court, as required, relied exclusively upon the allegations of the franchisee in its Complaint a summary of these facts is set forth below as part of the analysis.
Defendant Steak n Shake operates and grants franchises for restaurants offering burgers and milkshakes. Cornerstone initially sought information about one of Steak n Shakes traditional Classic restaurants, which notably operate twenty-four hours a day for seven days a week, feature a full menu, contain typically between 3000 and 4000 square feet of space, and offer dine-in, drive-thru, and carry-out service. Beginning January 2011, defendant began to also offer franchises for Signature restaurants, which, in contrast to the Classic restaurant, are smaller and offer a more limited menu.

Steak N Shake Has Closed More Than 100 Locations
Facing deepening sales and traffic declines and steep earnings declines, Steak n Shake has closed more than 100 locations so far this year, according to federal securities filings Friday from parent company Biglari Holdings.
The burger chain has closed 103 locations temporarily since the beginning of the year as it waits for operators to take them over. The company wants single-store franchisees to run the restaurants for a $10,000 fee and a split of the stores profits.
The number suggests that Steak n Shake has closed an additional 60 locations temporarily since the end of the first quarterwhen the chain closed 43 restaurants.
The temporary closures, along with another three closures listed as permanent, account for more than a quarter of the 413 corporate locations Steak n Shake operated at the end of 2018and 17% of the companys total unit count.
But the temporary closures also come amid deepening financial problems for the chain that are putting at risk the $183 million it has left on its loana loan that is not guaranteed by parent company Biglari Holdings.
Same-store sales in the second quarter ended June 30 declined 5.9%. Traffic, meanwhile, declined 9.2%.
The weak sales results are notable given that Steak n Shake has likely closed many of its poorest-performing locations.
So far this year, Steak n Shake has recorded $21 million in operating losses. The companys financials prompted a credit downgrade from the S& P 500 last month.

On Reddit, an employee noted that getting actual time off thats not on-call depends on who is in charge. Another employee stated that workers are expected to essentially be on call at all times, personal time is nonexistent.
Scheduling inconsistency can be especially hard for people who go to school or work other jobs, according to a former employee on Indeed.

Experts point to a decline in the quality of service and food, starting in 2008, as the main culprit for the chains declining popularity. This was the same year that new owner, Biglari Holdings Inc., took over the company and implemented some major changes to Steak n Shakes operational model.

Have walked by this place a few times whilst visiting Bordeaux and have never been too sure. It never looks that busy. I have to say though Ive just had a burger with mushrooms and Swiss cheese and its one of the best burgers Ive had in a long time. Washing it down with a surprisingly good bottle of Cab Sav watching the world go by is, on the whole, rather pleasant.
One of the best burgers we have eaten in Bordeaux. And thick delicious shakes. To top it off you get to eat in a cool restaurant.
