Steak And Shake Franchise

Since its inception in 1934 in Normal, Illinois, Steak n Shake has acquired significant brand strength and a devoted fanbase. Today, this 77-year-old iconic American brand, which pioneered the concept of quality Steak Burgers and hand-dipped milkshakes, has relaunched its franchising program.

And it is looking for single and multi-unit operators to help it develop its network of almost 500 QSR sites throughout 22 states.

Steak n Shake offers potential franchisees a wide range of investment and best-in-class aesthetic design options, including Steak n Shake Signature, a new smaller-footprint format well-suited for shopping centers, building on its current best-in-class string of 10 consecutive quarters of positive same-store sales growth despite the Great Recession.

Steak n Shake Signature is a low-cost variant with a more straightforward operation.

Things You Need To Know About The Steak N Shake Franchise

Avoids Bankruptcy and Refocuses on Growth

1. In early 2021, Steak n Shake announced that it might have to file for bankruptcy. After some maneuvering, Steak n Shake was able to avoid bankruptcy and in March the company announced that it had plans to open 12 new restaurants by the end of the first quarter of 2021. This is in addition to the 33 restaurants Steak n Shake opened in the fourth quarter of 2020.

2. Steak n Shake had previously closed restaurants that did not deliver excellent customer service. With the advent of its new owner-operator model, Steak n Shake intends to award every restaurant to an operator who provides legendary customer service. Unlike a typical franchising opportunity, which could cost over $2 million, Steak n Shakes program requires that an aspiring owner-operator invest a total of $10,000 and demonstrate exemplary service as an operator. Steak n Shake is making the American Dream a reality for those with talent and passion.

3. In 2020, Steak n Shake owner-operators earned, on average, $161,000 in their first year. Some are on their way to earning over $300,000. Today, there are 100 owner-operators, and each one is a true American success story. Steak n Shake encourages every general manager in the hospitality industry to apply if they are interested in working for themselves.

Steak N Shakes Change In Management

Experts point to a decline in the quality of service and food, starting in 2008, as the main culprit for the chains declining popularity. This was the same year that new owner, Biglari Holdings Inc., took over the company and implemented some major changes to Steak n Shakes operational model.

CEO Sardar Biglari had a fresh vision for the way Steak n Shake should operate: with high efficiency and low margins. As YouTuber Company Man explains, Biglari essentially wanted to sell more burgers for cheaper, where speed of service would be key in feeding the masses with not great, but good enough, burgers and shakes.

In order to achieve this, Steak n Shakes menu was pared down to the basicsburgers, fries, sodas, and shakesand its prices dropped to a uniform low across all locations. While sales started to rise for a while, they started slipping again in 2016.

Some of Biglaris changes have had a lasting impact on the burger chains appeal with customers. But thats not the only complaint.

Does Steak N Shake Franchise Provide Financial Assistance

There is no direct franchise financing provided by Steak N Shake. Any lease or note obligation cannot be guaranteed by the franchisor for the franchisee. Given that the business has a relationship with investors, it can offer third-party financing options that will cover startup costs, inventory, equipment, payrolls, and accounts receivable. SBA financing may be available to help with franchise purchases.

The franchisee plaintiff, Cornerstone Investment Partners I, LLC , sued its franchisor, Steak n Shake Enterprises, Inc., the defendant. The franchisor moved to dismiss the franchisees case, and the Court granted the motion. In deciding the motion, the Court, as required, relied exclusively upon the allegations of the franchisee in its Complaint a summary of these facts is set forth below as part of the analysis.

Defendant Steak n Shake operates and grants franchises for restaurants offering burgers and milkshakes. Cornerstone initially sought information about one of Steak n Shakes traditional Classic restaurants, which notably operate twenty-four hours a day for seven days a week, feature a full menu, contain typically between 3000 and 4000 square feet of space, and offer dine-in, drive-thru, and carry-out service. Beginning January 2011, defendant began to also offer franchises for Signature restaurants, which, in contrast to the Classic restaurant, are smaller and offer a more limited menu.

Ex-proprietors of a group of Steak n Shake restaurants must stop operating the former franchises under a new name after agreements between the Indianapolis-based restaurant chain and the ex-franchisees went south.

Chief Judge Tanya Walton Pratt of the U.S. District Court for the Southern District of Indiana entered a temporary restraining order Wednesday in favor of Steak n Shake Enterprises Inc. and Steak n Shake LLC. The order prohibits iFood Inc., Shashi K. Rattan and Chandru C. Gurnani from operating restaurants known as Seans Shack at three former Steak n Shake franchises.

Steak n Shake entered an area development agreement with iFood in 2011 allowing iFood to open 10 franchise locations across North Carolina and Virginia. At the same time, Rattan and Gurnani entered into franchise and license agreements to operate a full-service Steak n Shake in Raleigh, North Carolina. The parties later executed additional agreements to open two franchises in Raleigh and Vienna, West Virginia, as well as one franchise in Garner, North Carolina

Second, the geographic scope of the noncompete provision is not unreasonably broad when, again, Plaintiffs may elect to reenter that market, and the barred territory is constrained to within five miles of the Authorized Location or any then-existing Steak n Shake or Steak n Shake Signature Restaurant, Walton Pratt continued.
