Exceptions If You Already Have A Contract

If you already have a written and effective contract in place with a business, they can still contact you by phone, schedule a visit to your home for any reason you request, including repairs and maintenance, and enter into a new contract. However, the business must tell you if they plan to offer you one of the restricted products and services before visiting your home and you would have to agree to hear their offer before they can do so.

Traveling Salesmen Try Selling $400 Worth Of Frozen Steak To Neighbors In The Heights

ALBUQUERQUE, N.M. People in northeast Albuquerque have their guard up after some salesmen selling frozen steaks from the back of a pickup wouldnt leave them alone.

Several neighbors said they are creeped out. They said they felt intimidated and threatened into buying hundreds of dollars of meat.

Once I realized by the time they left that they were not who they said they were, I got really really mad, Jaci Szczepanski said.

Neighbors in the Northeast Heights said they feel violated.

This is my neighborhood, Szczepanski said. Get out of my neighborhood.

This comes after a pair of traveling salesmen tried to make them buy more than 40 steaks for more than $400 near Louisiana and Alameda.

We are kind of like Schwans, one of the men said in doorbell video. We do all-natural products like steak, chicken and seafood.

The two men hauled in the meat from a cooler in the back of a pickup truck.

This is kind of good for you, one of the men said. It is better than what you get in the store.

Szczepanski didnt buy it.

It doesnt take a lot to get a bunch of steaks and freeze them in that way and make yourself look like a business, Szczepanski said.

The men claimed they were with Midwestern Steak and Seafood, but they would not provide a business card.

Do you have a card? Szczepanski asked. Like I said, you can check us out online, the man responded.

The city said there are no permits listed for the company, meaning they are likely illegal vendors.

Three Tips To Keep In Mind

  • Remember that if you sign a new contract for a product or service, such as a water heater rental, you will have to end your existing contract with your current supplier. There may be fees for ending your current contract and having your existing product or service removed.
  • You may be eligible for an upgrade from your current supplier. Call them and check your options before upgrading with a new supplier.
  • When you buy a home, you may be taking on the responsibility for an existing appliance contract that comes with the home. Ask your real estate agent or your lawyer.

After You Enter Into A Contract

REVOLVING DOOR ENTRANCE to MICHAEL JORDAN STEAK HOUSE ...

Once you have a written copy of the contract, you still have a 10-day cooling-off period to cancel a contract, for the restricted products or services, for any reason.

If you dont receive a written contract, or the contract you receive doesnt include required information about the products or services, you can cancel the contract within one year from the day you entered into it. You can also cancel the agreement within one year if the business who youve signed your contract with has made a false or misleading statement about the contract.

If you sign a contract for a restricted product and service as a result of restricted door-to-door marketing or due to misleading marketing materials left at your home, the contract will be considered void and you can keep the goods or services without obligation.

If the contract is void and you are charged penalties or fees from third parties the business is required to reimburse you for those charges.

You And The Law: Beware Fake Omaha Steaks Being Sold Door To Door

If you love to barbecue, then if I say Omaha Steaks, the next word that pops into your head will probably be dinner, followed by mouth-watering, followed by dinner once more, and that will be followed by Wheres my credit card?

Omaha Steaks is a company with instant name recognition. After close to 100 years, it is still family-owned. Five generations have been selling some of Americas finest beef at a premium price through mail order, retail stores, a website and an 800 number.

As Americans are meat lovers, and Omaha Steaks do cost more than supermarket meat, this has opened the door to con artists ripping off their good name, selling inferior cuts of meat to an unsuspecting public.

The phone call You and the Law received from a Lemoore reader is a good illustration of how imitation is the highest and in this case, illegal form of flattery.

A truck shows up in your neighborhood

Bonnie lives in Lemoore and is married to Ted, a Navy pilot.

She phoned You and the Law, explaining, There is a blue and red van on our street with a guy wearing what looks like a butchers white outfit, going door to door, telling people that he is overstocked with Omaha Steaks, which we can buy for a discounted price.

We love to barbecue and had Omaha Steaks once, which we thought were great, but I am very suspicious of meat being sold this way. Is this legit or a scam? Is it legal to sell meat door to door?

Before You Hear A Sales Pitch

When you open your door to a salesperson, remember:

  • ask for photo ID and get the name of the person and the business
  • never share personal information
  • if you ask a salesperson to leave, they must leave right away. If you feel unsafe, call local police
  • look at the company name on the salespersons business card and promotional material and see if it matches the company name on the proposed contract
  • do not rely on a salespersons opinion that your water heater is unsafe or should be replaced
  • local utility companies, municipalities, government agencies or regulatory organizations dont send salespeople door-to-door
  • you do not have to sign a contract on the spot

Your Rights When You Sign A Contract In Your Home

The Consumer Protection Act, 2002 gives you rights when you buy something from a salesperson either at your door or in your home that costs more than $50.

As a consumer, you:

  • have the right to cancel a contract without any reason within a 10-day cooling-off period, beginning the day you receive a written copy of the agreement.
  • must be given a written contract: under the CPA, a consumer contract has to include specific information about the goods or service and your rights as a consumer. If it doesnt, you can cancel the contract within 1 year of entering into the agreement.
  • can cancel the agreement, regardless of its value, up to one year after you entered into it if the business or salesperson youve signed your contract with made a false or misleading statement about the contract.
  • duct cleaning services
  • any good or service that performs or combines one or more of the above functions

Businesses will be able to enter into a contract at your home if you contacted them ahead of time and invited them to your home for the purpose of buying or leasing one of the restricted products and services.

If you call for a repair, maintenance, an energy assessment, or any reason other than entering into a contract for one of these items and the business comes to your home, the business cannot enter into a new contract with you. They will only be able to leave information about the products and services they offer.

Door To Door Meat Bundle Scam

Have you been approached, without appointment, by a door to door salesperson selling meat bundles from the back of a truck? If not congratulations as these hustling scammers are like a plague with outbreaks in nearly every community. They are now easy to recognize as the technique and sales pitch is near identical only the name of the peddler changes. It starts with a knock at the door and there stands a stranger asking if youd like to get a great deal on steaks?

Although they are highly trained and usually take advantage of the naive and the elderly, if you were a victim you, dont be embarrassed as you are not alone as these guys play by a different set of rules and many are experts in the con.

Because the product typically comes from large processors sold through brokers of the lowest grade beef pumped up with unpronounceable additives and preservatives it has to be packaged in colorful boxes for presentation purposes, and then sold by the pallet to companies that in turn have their delivery guys to go sell it for a commission. If you search for variety steak case , meat bundle, six pack steak case or meat scam youll undoubtedly find numerous companies throughout the U.S that use this approach. Many are being sued, investigated by various enforcement agencies, and an untold number of victims.

Door To Door Meat Sales

Some things seem like good ideas and some just dont. This falls under the dont category.

Ive told my wife, If I ever buy meat from a door to door salesman, please just shoot me on the spot.

Source: Komo News.

Update: Many folks have pointed out that there are some quality, ethical meat salesmen that sell meat door to door. I actually have some friends of mine that are very happy with the meat they recently got from a meat salesman that came by in a MARKED, refrigerated truck.

Another alternative is just getting the meat on the internet. That is pretty much how everything is sold these days.

So, I think this falls under the same rules as just about everything else. DO YOUR HOMEWORK.

Costs You May Still Have To Pay

Be sure before you sign. If your contract has a 10-day cooling-off period, you may still have to pay some costs if you solicited the product from the business and requested that the equipment be installed in your home before the 10 days are over. These costs may include:

  • any rental payments, which are still due if you cancel
  • any expenses the rental company must pay to remove the product or service
  • charges for unreasonable or excessive wear or use of the product or service

Is It Safe To Buy From Door

May 21, 2021 By Allen Francis

They say trust is dead in America, but I dont believe that. Did you know that 51% of Americans harbor some form of trust in their fellow Americans? That may not sound much, but it should if you consider the current political environment that we are collectively experiencing. I thought the trust factor percentage would be a lot less. Get this door-to-door meat sellers are actually a thing in the United States.

According to this article from Vice, door-to-door meat sellers are more prolific in rural and suburban locales than urban centers. On that point, I disagree.

I grew up in the South Bronx, and every once in a while, an earnest salesperson would knock on the door and ask if we wanted to buy meat from his car. I politely said no while looking at him like he had three heads.

Then he proceeded to knock on every door on my floor I remember watching him knock on a few doors after me. And then he disappeared into the stairwell, ostensibly to knock on a few more doors.

I really dont know what I would buy from a traveling salesperson knocking on my door. People used to sell encyclopedias or insurance policies door-to-door when I was a kid. But now we have the internet where you can find such information yourself.

The last thing I would do is buy meat from a complete stranger knocking on my door. Perhaps this was a normal thing to do in 1951, but it is 2021.

However, Americans are more trusting than I believed.
